General Terms and Conditions

article 1. Scope

1.1 These General Terms and Conditions (GTC) apply to the use of the social media platform "Unartig" (hereinafter referred to as "Platform").

1.2 The operator of the Platform is Roland Hechwartner (hereinafter referred to as "Unartig").

1.3 By registering and using the Platform, the user agrees to these GTC.

2.1 Unartig operates a social media platform on which users can publish and share content as well as offer and consume videos or live sessions.

2.2 Certain functions are subject to a fee and require an active user account.

2.3 There is no entitlement to specific functions or permanent availability.

4.1 Membership fees are to be paid in advance.

4.3 Payments already made will not be refunded, even in the event of account deletion.

account_balance_wallet 5. In-App Currency and Billing

5.1 Earnings are billed twice a month.

5.2 Payout takes place after invoicing to the specified account or is offset against open amounts.

5.3 Users are themselves responsible for tax obligations and shall hold Unartig harmless.

verified_user 6. Verification

6.1 Uploading and offering videos or live sessions for rent is only permitted after full verification.

18_up_rating 7. Age Restriction

7.1 Use of the Platform is permitted only to persons aged 18 and over.

7.2 By registering, the user confirms that they are of legal age.

7.3 The user is obligated to ensure and verify that all persons depicted in uploaded content are at least 18 years of age. This obligation applies to every individual recognizable in any content published on the Platform.

7.4 The Platform reserves the right to immediately remove content where there is suspicion that depicted persons are minors and to suspend the corresponding accounts without prior notice.

copyright 8. Usage Rights to Content

8.1 The user grants Unartig a simple, non-exclusive, temporally and spatially unlimited right of use to display, distribute, and technically process content within the framework of the Platform.

8.2 Any further use shall only take place with separate consent.

8.3 The user remains the owner of their content.

8.4 The user warrants that all persons depicted in the content have given their express consent both to being recorded and to the distribution of the content via the Platform. Such consent must be obtained prior to the creation and publication of the content.

8.5 Without verifiable consent of all depicted persons, the distribution of the content on the Platform is not permitted. The user is solely liable for all damages arising from a breach of this obligation and shall indemnify the Platform against any third-party claims.

9.1 Users are solely responsible for their content.

9.4 Users undertake to report illegal content to support.

10.1 Unartig is entitled to remove content at any time without giving reasons.

10.2 In the event of violations, accounts can be blocked or deleted.

10.3 There is no entitlement to the restoration of content or accounts.

11.1 Illegal content will lead to immediate reporting to the authorities.

11.2 This also applies to the consumption of such content.

error 12. Liability

12.1 Users are fully liable for their content.

12.2 Users shall hold Unartig harmless.

12.4 No entitlement to refund for unavailable content.

13.1 False information leads to deletion.

13.2 Unartig can check accounts at any time.

settings 14. Availability and Maintenance

14.1 Unartig does not guarantee continuous availability.

14.2 Maintenance work can take place at any time.

14.3 Technical faults do not justify any claims.

15.1 Users expressly agree that digital services begin immediately.

15.2 Users waive their legal right of withdrawal when usage begins.

16.1 Payment processing can take place via third-party providers.

16.2 Their GTC apply to their services.

16.3 Unartig assumes no liability for third-party providers.

business 17. Commercial Use

17.1 Professional users act as entrepreneurs.

17.2 Consumer protection regulations do not apply in this respect.

balance 18. Contractual Penalty (optional)

18.1 In the event of serious violations, an appropriate contractual penalty can be imposed.

shield 19. Data Protection

19.1 Personal data is processed in accordance with the Privacy Policy.

19.2 This is an integral part of using the Platform.

20.1 Support takes place via the contact options provided by Unartig.

20.2 Response times are non-binding.

edit 21. Changes to the GTC

21.1 Unartig reserves the right to change these GTC at any time.

21.2 Users will be informed.

21.3 Continued use shall be deemed as consent.

cancel 22. Termination of Contract

22.1 Unartig can delete accounts at any time in the event of violations.

22.2 There is no entitlement to a refund.

23.1 Austrian law applies.

23.2 The place of jurisdiction is Vienna, as far as permissible.

23.3 Should individual provisions be invalid, the remainder remains valid.
